Question
Assalaamu'alaikum
Pray you are well.
Questions from a few students:
1) In regard to Zakat, if someone makes intention to sell a car that they have been using for personal use. Do they have to include sale price in Zakat calculation while it is on for sale?
2) If a father has taken a long term loan, but the son is making monthly repayments for it. Is the son allowed to deduct the immediate repayment from Zakat wealth?
3) A person has started process of purchasing a second house, the offer has been accepted by the buyer. Solicitors are now carrying out their checks etc and other legal processes, it is expected to be a couple of months before money is paid for the house. Can person deduct this amount from Zakatable wealth?
4) What is ruling of delaying Isha past middle of night?

Answer
Wa `Alaykum al-Salām
1) The car that has been being used for personal use is not a Zakātable asset. Zakāh will not be obligatory upon the car even if it is on sale. Once it has been sold then the money received will be zakātable.
2) As the loan belongs to the father and not the individual, it won't be subtracted from the son's wealth in the Zakāh calculation. However, any amount already paid at the time of Zakāh becoming due will no longer be deemed part of the son's wealth and will not be factored into the Zakāh calculation.
3) If Zakāh becomes due after the confirmation of the transaction, meaning the offer ('ījāb) and acceptance (qubūl) have occurred, the corresponding amount will be deducted in the Zakāh calculation because the individual now owes that wealth due to the finalized transaction. However, if the transaction conditions have not been met and Zakāh becomes due, the wealth in question will still be considered in the Zakāh calculation.
4) Delaying `Ishā congregation past the middle of the night has been deemed makrūh due to the likelihood that fewer people would join for jamā`ah (congregation) at this time. It has come in Fatāwā Riḍawīyah,
عشا میں وقت کراہت آدھی رات کے بعد ہے۔
"For `Ishā, the makrūh time begins after the middle of the night." (Fatāwā Riḍawīyah: Vol. 5, Pg. 149) And Allāh knows best.
